Man accused of raping boy to stand trial
An Aaronsburg man in jail on charges he raped a 6-year-old boy in the fall of 2006 will stand trial, a district judge ruled Wednesday. Steve Allen Foltz, of 5543 Penns Valley Pike, admitted to police that he touched the boy inappropriately one time at the Bellefonte home of the boy’s grandmother, state police at Rockview wrote in a criminal complaint.
The boy testified at a closed hearing Wednesday in which the defendant was listening in through video-conference after Judge David E. Grine ruled that the boy would be too distraught to testify with Foltz in the room.
Only court personnel, the judge, prosecutor Yvette Willson, Foltz’s attorney First Assistant Public Defender Deb Lux, and the boy’s family were present.
Foltz had admitted to police that a sexual act and sexual touching happened, but said it was “by accident,” police wrote.
District Judge Leslie Dutchcot ruled Foltz will face trial on charges of rape of a child, involuntary deviate sexual intercourse with a child and several other charges.
Man to go on trial on pill theft charges
A State College man will stand trial for stealing more than 5,000 prescription pills, a biohazard bucket full of used syringes and hundreds of medical records of patients at Universal Community Behavioral Health, a facility at The Meadows in Bellefonte.
District Judge Leslie Dutchcot found enough evidence for Jason Bevilacqua, 32, to stand trial on burglary, trespass and theft-related charges after a hearing with prosecutor Yvette Willson and Bevilacqua’s attorney, First Assistant Public Defender Deb Lux.
Police say Bevilacqua burglarized the building at 206 W. High St., and they later found garbage bags full of the stolen items in his car. Park rangers told police they saw Bevilacqua burning the medical records near Sayers Dam at Bald Eagle State Park. A search warrant indicates he stole the records for all patients with last names “A” through “K.”
Police say those records can be replaced.
Woman appeals sentence for attempted murder
The Muncy woman who tried to kill her husband three times in Centre County in 2007 is appealing her 111/ 2-to 23-year prison sentence to the Superior Court.
The attorney for Christine Balliet, Tami Fees, filed a notice of appeal Monday, after Senior Judge Charles C. Brown Jr. denied a motion filed by Balliet’s previous attorneys to reconsider the sentence. They had argued that the sentence was excessive.
In September, Balliet pleaded no contest to the charges. She’s accused of attempting to murder husband Ron Balliet by stabbing him, then by trying to run him over with her car, and by seeking out a hit man from her jail cell.
Ex-PSU linebacker charged with DUI
Former Penn State outside linebacker Tyrell A. Sales has been charged with DUI after Patton Township police arrested him on March 28.
Sales, 23, graduated in 2008 with a degree in marketing from the Smeal College of Business, and was reportedly training for the NFL draft. He was seen making two turns without signaling on Vairo Boulevard and Oakwood Avenue around 3 a.m. when he was pulled over, police said. He was arrested after failing field sobriety tests and later found to have a .156 blood alcohol level, police said.
Man taken to hospital after attack, robbery
A 31-year-old man was taken to Clearfield Hospital and later released after police say a 23- year-old Philipsburg man struck him with a metal support post from a trampoline and tried to break into his residence.
Joshua P. Miller then forced his way into the man’s home and hit him again, police said.
The victim told police he lost consciousness and when he woke up, he found his wallet containing $372 was stolen. He had a large laceration and swelling on his right cheek and arm.
