Madeira wants out of suit against county
District Attorney Michael Madeira is asking to be dismissed from a lawsuit filed by a former victim of domestic abuse against the county, Madeira and former prosecutor Lance Marshall.
A federal judge dismissed civil rights violations alleged by the woman, but sent back to county court three counts having to do with intercepted telephone calls the woman made with her jailed boyfriend, whom Marshall was prosecuting.
The woman said Marshall listened to her conversations to promote his sexual advances on her, and Madeira didn’t properly supervise him.
The woman says Marshall sent her hundreds of text messages and voice mails in a two-week period, some soliciting sex, and asked her to lie on the witness stand. Marshall resigned shortly after the woman came forward.
Centre County has already filed a motion similar to Madeira’s, stating Marshall was a prosecutor at the time and had the right to listen to the boyfriend’s conversations.
