BELLEFONTE — A woman testified Wednesday that a Philadelphia man continued to have sex with her after she asked him to stop and told him it was painful.
The testimony was during a preliminary hearing in a rape case against Ibnyasin A. Talley, 36, who was arrested in Philadelphia early last week on the charges. State College police alleged Talley forced the woman to have sex with him after he arrived at her Waupelani Drive apartment around 3 a.m. Nov. 13.
After the hearing, District Judge Tom Jordan bound over rape and sexual assault charges for possible trial.
The woman testified she consented to oral and vaginal intercourse, but once the sex started to be painful, she said she asked Talley to stop, but he didn’t. He also forced her to have anal sex, she testified.
The woman called her cousin to come over after Talley left. The cousin testified she arrived to find the woman hysterical and shaking.
Talley’s attorney, public defender Casey McClain, argued to the judge that a rape charge wasn’t appropriate because the woman had consented to some of the sexual contact and that his client didn’t threaten the woman. Prosecutor Kelley Gillette-Walker said the incident was violent and warranted a rape charge.
The judge kept Talley in jail on $100,000 straight bail.
