Students face felony for trespassing during riot

Penn State police said two drunken students who climbed on top of a construction site to watch the Nov. 9 downtown riot are facing felony trespassing charges.

Police heard noises coming from the site near the Henderson Building on campus and later found Zachary J. Rutledge, 23, and Nicholas P. Morris, 20, both of Pittsburgh, walking down steps from the third floor, according to charging documents filed Monday. Police said the construction site was marked with signs stating “authorized personnel only.”

Police said the construction site consisted of multiple floors of steel I-beams, metal flooring and open staircases. There were no walls but only safety rope to keep construction workers from falling off the edge, police said.

Rutledge and Morris were released on their own recognizance and are scheduled for a preliminary hearing Jan. 18.
