Prosecutors say they will provide Jerry Sandusky’s attorney, Joe Amendola, with the names of his accusers by Friday, but argue that they should not be required to provide other details requested by Amendola.
In a document filed Monday in Centre County court, Senior Deputy Attorney General Jonelle Eshbach wrote that the identities of all 10 victims mentioned in two grand jury presentments will be delivered to attorney Joe Amendola by the close of business Friday.
In the grand jury presentments, two of the alleged victims had not been identifed. It was unclear whether prosecutors now know the identities of those people.
Sandusky, former Penn State football defensive coordinator, is charged with sexually abusing 10 boys over a period of 15 years. He has steadfastly maintained that he is innocent of the charges.
Eshbach’s filing comes in response to Amendola’s requests for the names, ages and addresses of Sandusky’s accusers as well as information about where and when each of the alleged instances of sexual abuse occurred.
But Eshback is asking the judge to deny Amendola’s request for information beyond the accusers’ names. She wrote that the request is an attempt to discover prosecutors’ trial evidence and strategy and that the information in the presentment explains the allegations.
“The request is not a vehicle by which the Commonwealth must recite, verbatim, all of the evidence which is in its possession, its theories of the case, the applicability of those theories to the law, and, among other things, names of witnesses, co-defendants, or statements of co-defendants,” Eshbach wrote.
Sandusky is scheduled to be in court Feb. 10 for a hearing on modifying his bail to allow him to have visits with his grandchildren.
