Sue Paterno and son Jay may testify in Jerry Sandusky case

— The wife and a son of the late Joe Paterno may be among the witnesses called to testify at Jerry Sandusky’s trial.

Also on the list are assistant coach and former player Mike McQueary, on leave, who has been a key witness in the case. He has testified that he walked in on Sandusky naked in the shower with a boy.
Members of the Sandusky family and Central Mountain School District officials could also be called to testify in the case, which could see opening arguments as early as Monday.

Second Mile CEO Jack Raykovitz and interim CEO Dave Woodle may also be witnesses.

The potential for Jay and Sue Paterno to be called as witnesses came out during the jury selection process that went on all day Tuesday.

McQueary has testified that he told Joe Paterno about what he saw.

Jules Epstein, an expert in criminal law who teaches at Widener University’s law school in Delaware, said anyone subpoenaed must respond and testify unless he or she can claim it’s privileged.

For instance, he mentioned confidential communication between spouses.

Also Tuesday, Penn State issued a statement, saying: “The acts that Jerry Sandusky is accused of committing are horrible and if proven true, deserve punishment.

“In deference to the legal process, the university will not comment on specifics of the ongoing legal case as it unfolds. We are hopeful, however, that the case proceeds quickly and provides answers we are all seeking. We are further hopeful that the legal process will start to bring closure to the alleged victims and families whose lives have been irrevocably impacted and that they can begin the healing process.

“We continue to work with the (s)tate (a)ttorney (g)eneral, the U.S. (a)ttorney and former FBI (d)irector Louis Freeh in their investigations into this matter. We will continue to cooperate fully with all legal processes to determine what happened and ensure personal accountability.”
