Judge in Jerry Sandusky case orders defense to explain reasons for appealing gag order

— The judge in the Jerry Sandusky case ordered defense attorney Karl Rominger to file a statement detailing the reasons he's appealing a protective order.

The order Judge John Cleland issued today essentially clarifies the process for appealing the order.

On July 12, Rominger appealed Cleland's order to stop the leaking of information related to the case that hadn't been introduced at trial. Cleland also directed defense attorneys to give him and the supervising grand jury judge under oath a list of materials and list of those with whom they had shared them.

Rominger argued on appeal that the order could force the defense to share its thoughts and strategies on the case.

In response, the state argued Rominger hadn't followed the proper procedure when he filed his reasons of appeal before the judge issued an order. If the correct process isn't followed, that could open the door to an appeal on this particular issue in the future.

Cleland's ruling today grants the prosecution's request and strikes Rominger's previously filed reasons for appeal. Rominger has 21 days to refile those reasons.
