The property owners whose State College Borough Council-approved rezoning request was vetoed by Mayor Elizabeth Goreham have filed an appeal with the county Court of Common Pleas.
Susan Venegoni-Lestz and Dan Lestz filed the civil appeal on Wednesday, simply stating that they appeal Goreham’s veto of the ordinance to rezone their home, 323 W. Fairmount Ave.
The residents also have filed a state ethics appeal against Goreham, arguing she should have recused herself from action on the ordinance because she and her husband, Jack Matson, own a rental property across the street, 332 W. Fairmount.
Goreham and Matson last week submitted written notice to the borough Planning Department that they formally abandon the student home permit assigned to the home. Goreham said they have not rented to students since purchasing the home in 1999.
County court administration officials said Judge Bradley P. Lunsford was assigned to the case and will schedule a conference with the parties.
