BELLEFONTE — Two Bucks County men were acquitted Wednesday of assault charges stemming from an incident in October at The Gingerbread Man in State College.
Police had said Ryan Emilius, 23, and Colin Emilius, 24, both of Holland, refused to leave the bar and were being escorted out.
Defense attorney Philip Masorti said Ryan Emilius testified he didnt hit anyone, and Colin Emilius testified he hit a bar employee after he was assaulted and saw his brother, on the ground, kicked by a bar employee.
Masorti said the brothers werent looking for trouble that night when they were visiting State College for a friends 21st birthday bar tour.
The jury saw a video of the incident, which Masorti said showed the employees used outrageous force that was totally disproportionate to what little resistance was offered by my clients.
The jury sided with a self-defense argument.
If the jury found self defense to be an issue in this case, we accept that determination and are always grateful to jurors for carrying out their duty, said District Attorney Stacy Parks Miller.
