Jury finds Philipsburg man guilty of DUI

— A Philipsburg man was convicted of two counts of driving under the influence on Wednesday after a trial.

Timothy Kolbe, 47, had a 0.293 blood-alcohol level when state police said they found him Nov. 7, 2010, in his car, a short distance from his estranged wife’s house on Spruce Street. The car wasn’t moving but was on, and Kolbe was behind the wheel.

Kolbe denied he had been drinking.

On Wednesday, the jury saw the police video of the traffic stop and heard from the estranged wife, who testified for prosecutors.

Kolbe did not testify on his behalf.

The defense argued Kolbe was not in control of his car, which is part of the DUI statute.
