Benner Township asks federal judge to drop civil rights suit

— Benner Township has asked a federal judge to dismiss the civil rights suit against it by its former zoning and code enforcement officer.

The township, in a motion filed Thursday in U.S. District Court, contends the suit filed by Renee A. Swancer should be dismissed because the Milesburg resident failed to allege her position did not require political affiliation.

Swancer sued in August contending Republican supervisors Randy Moyer and David Wise demoted and then fired her because she supported a Democrat. She also claims Moyer promised to fire her if elected.

She is seeking reinstatement, lost pay since her termination in January and unspecified damages.
