No court ruling on decision to award Garman Theatre to State College developer

— President Judge Thomas King Kistler did not issue a decision Thursday on the Bellefonte Industrial Development Authority’s plan to award the opportunity to purchase the Garman Theatre to State College Developer Ara Kervandjian.

He must approve that plan before it becomes official.

On Wednesday, the Bellefonte Historical and Cultural Association filed a petition to intervene in the Centre County Court of Common Pleas, an attempt to gain official legal standing. The organization is asking for the court to hold another hearing and deny Kenvandjian’s final plan.

The petition states that the BHCA is legally able to rehabilitate the building, claims the IDA is not legally qualified to serve as conservators, the Bellefonte Borough is biased, Kervandjian doesn’t currently have the funds in place to execute his plans and the building has a restrictive covenant that says it should not be knocked down if it is structurally sound.

Kistler said in a previous court order that he plans to act without another hearing.
