Sheetz buys Potter Township parcel

Sheetz Inc. has purchased a parcel of land on Old Fort Road in Potter Township, according to real estate transfers.

The Altoona-based company paid $840,000 to Old Fort Road Limited Partnership and Old Fort Road Management LLC.

The purchase of the land was blocked in 2009 by a lawsuit by J.J. Powell Inc., which operates a Snappy’s convenience store across the street from the parcel.

The suit was centered on whether Sheetz was attempting to lease the land, a move that would have violated a covenant in the lease between J.J. Powell and the Smith-Pletcher Home Association, which owns all four corners of the Old Fort intersection.

Under the J.J. Powell lease covenant that runs until 2023, the former Smith-Pletcher Home Association parcel cannot be leased for a competing convenience store.

A Centre County Court of Common Pleas judge rejected that lawsuit in April 2012, and the state Superior Court said Powell failed to make a case that the Sheetz deal violated the covenant.
