A Tennessee man who was charged last week with exposing himself in public in State College now faces possible trial, and will continue to sit in the Centre County Correctional Facility if he can’t post $10,000 bail.
Police said Anthony Smallwood, 45, waived his right to a preliminary hearing Wednesday on misdemeanor counts of indecent exposure and open lewdness and a summary count of disorderly conduct.
Police wrote in charging documents that witnesses reported seeing an intoxicated man, later identified as Smallwood, expose himself at the Comfort Suites on Village Drive around 3 p.m. Friday.
He was allegedly seen standing with his pants down, looking through his wallet on the first-floor of the hotel, facing the neighboring Step by Step School for Early Learning.
Smallwood’s attorney, public defender Deborah Lux, said her client is in the area working on a construction project and asked District Judge Allen Sinclair to lower bail so Smallwood could return to his job.
Prosecutors asked that bail remain the same, and Sinclair kept it at $10,000.
