Settlement reached in 2012 I-80 accident

A $190,000 settlement has been reached through mediation of the federal lawsuit that stems from a 2012 accident in which steel coils fell off a tractor-trailer truck on Interstate 80 in Clinton County.

Notice of the settlement in the suit filed by Carol G. and Herbert S. Diamond, of Lennox, Mass., was filed Wednesday in U.S. Middle District Court.

The Diamonds were injured when steel coils fell from a flatbed truck after it clipped the rear of another rig at about 10:20 a.m. on April 19, 2012, in Lamar Township.

The state police report stated that Erwin J. Adams, of Hempstead, N.Y., removed his seatbelt and bent over to pick up a piece of paper in the cab.

When he looked up, he saw he was approaching a slow-moving rig.

He swerved to miss it but clipped it, causing the coils to fall from his truck, police said.

One of the coils hit the front of the vehicle driven by Carol Diamond and another rolled onto it, the accident report states. Adams was ejected and taken to Geisinger Medical Center in Danville for treatment of his injuries.

The defendants were Adams and the owners of the two trucks, both from out of state.
