Penn State to file ‘statement of errors’ on Paterno suit

Penn State has to point out its problems with the Paterno family’s lawsuit.

Potter County Senior Judge John Leete signed an order Oct. 14 directing the university to file the document in the suit brought by late former head coach Joe Paterno’s estate, Penn State trustee Al Clemens and former assistant Nittany Lion coaches Jay Paterno and Bill Kenney against Penn State and the NCAA for defamation and other alleged offenses.

Penn State filed a notice of appeal in the case, prompting the judge’s order.

“The nominal defendant, Penn State University, shall file of record a statement of errors complained of on appeal within 21 days,” Leete ordered.

He also stipulated that the university “is hereby notified that any issue not properly included in the timely filed statement shall be deemed waived by the appellate court.”

The document was recorded in the Centre County Prothonotary’s Office on Tuesday.
