Centre County wants jurist from elsewhere to hear contempt of court request from Parks Miller

Attorneys for Centre County government want an out-of-county judge to strike a request from Centre County District Attorney Stacy Parks Miller finding the county in contempt of court.

The county motion claims that the Court of Common Pleas no longer has jurisdiction in the lawsuit filed against them by Parks Miller because of appeals entered by the county to the Commonwealth Court.

Earlier this week, Bruce Castor Jr., Parks Miller’s attorney, asked Huntingdon County Senior Judge Stewart L. Kurtz to hold the county in contempt of court and impose sanctions after county Administrator Tim Boyde denied a Right-to-Know request from the county Public Defender’s Office asking for communication records between Parks Miller and Judge Bradley P. Lunsford.

Castor argued that Boyde violated an order entered by Kurtz last month when he responded to the request and should have instead forwarded the request to Parks Miller.
