A woman sought shelter at a neighbor’s home after being assaulted by her boyfriend, Austin Thomas Earhart. He then pulled a gun on the neighbor. On Tuesday, he pleaded guilty in Clearfield County.
Earhart, 22, of Philipsburg, was sentenced to five days to one year in jail and one year consecutive probation by President Judge Fredric J. Ammerman for simple assault. Originally, he was also charged with terroristic threats.
Because this is a domestic violence case, Earhart is no longer allowed to possess a firearm. The gun in evidence will either be destroyed or sold with proceeds applied to his fines and costs.
According to the affidavit of probable cause, the woman found emails between Earhart and other men on Craigslist on Oct. 25. The incident took place at a Madera residence.
When she got home from work that night, Earhart kept talking to her as she tried to sleep. He continuously asked her what was going to happen between the two of them, she told police.
When she asked him if he liked guys, he “freaked out” by grabbing her by the throat and squeezing it. He also smacked her head off the cabinet, police said.
She reported that she blacked out briefly, but remembered trying to get to the back door when he stopped her. She was able to get to the bedroom.
When she said that he was gay, Earhart kicked her in the back and threw her on the bed, according to investigators.
The victim told police that Earhart grabbed her by the throat again, put his elbow on her throat and pushed her down. He also slapped her across the face.
After she told him she wouldn’t tell anyone if he let her go, he stopped, and she ran to the neighbor’s house.
While she was there, Earhart showed up and asked for her. The owner of the home opened the door and told Earhart to take a walk.
It was then that Earhart reportedly pulled a pistol from his waistband and directed it toward the neighbor. The neighbor slammed the door and told everyone in the home to get down. He asked his wife to call 911.
The investigating officers could see red marks on the victim’s right tricep, chin and left cheek bone, as well as a bump on her right elbow. She told them that her neck was hurting from the assault.
Police found Earhart passed out on his couch, and he was taken into custody.
