Charges were filed Monday against a Benner state prison inmate accused of hitting a corrections officer with a plastic chair.
James Fleming, 49, is charged with aggravated assault, simple assault and harassment in relation to an incident on the evening of Jan. 3, according to court documents. A guard at the prison told state police that he told Fleming to return to his cell and Fleming refused, according to the criminal complaint. Fleming then reportedly grabbed a plastic chair and swung it at the officer, hitting him in the arm, police said. Fleming grabbed another chair from a stack and threw it before additional personnel arrived, the officer reported to police. Fleming then became compliant and was taken into custody, police said.
Video footage at the prison show Fleming hitting the guard and throwing the other chair, according to the criminal complaint.
