Glenn O. Hawbaker sues developer for more than $1.1 million, alleges unpaid bills
A major State College-area construction contractor filed a lawsuit Friday that alleged the developer of the former Harner Farm property hasn’t paid in months, amassing more than $1.1 million in outstanding bills.
Glenn O. Hawbaker Inc.’s attorney wrote in the 81-page suit that Aspen Whitehall Partners stopped paying in September for work that has continued in Ferguson Township.
A voicemail was left with the developer. Hawbaker declined comment Wednesday through a spokesperson.
The two businesses inked an about $3.6 million contract in summer 2020 for the development of Sheetz and Orchard View, a housing development.
The developer paid nearly two-thirds of the contract between August 2020 and September, but hasn’t paid its bills since despite promising payment would come in a matter of days, Hawbaker attorney Robert Palumbi wrote.
Hawbaker has not received a deficiency notice from the developer or a written justification for not paying, Palumbi wrote.
“The Owner knew they did not have the necessary funding to pay GOH, but represented otherwise in order to induce GOH’s performance,” Palumbi wrote. “Upon information and belief, the Owner received funding to pay GOH, but instead directed that funding elsewhere.”
