State College business sued for more than $300,000
A dispute between two State College-area contractors is going to the county’s Court of Common Pleas.
Glenn O. Hawbaker Inc. recently filed a lawsuit for $301,703.91 plus interest and attorney’s fees against Ameron Construction Company Inc.
The lawsuit alleged that Hawbaker Inc. agreed to act as a subcontractor for Ameron on Win-SC LLC’s development project in Patton Township. The project was at the former A&P site, purchased by Win-SC LLC in 2014. The site was developed into five businesses including Panda Express, Qdoba, Mattress Firm, Vitamin Shoppe and Great Clips.
Hawbaker Inc.’s work on the project was completed in November 2016 when the company submitted invoices to Ameron for its services, according to the suit. Ameron allegedly has failed to pay Hawbaker Inc.
A January 2015 purchase order for $168,180.15 described Hawbaker Inc.’s obligation to provide labor, equipment and material to install sub-base stone with geotextile and site asphalt. A September 2016 purchase order for $111,180 described the subcontractor’s obligation to provide labor, equipment and material to install a turn lane on North Atherton Street and nearby intersection work. Additional charges increased the amount due to Hawbaker Inc. to more than $300,000.
Ameron has not responded to requests for comment.
