She said no, but he continued to touch her, police say
A Huntingdon County man faces charges in Centre County after an alleged indecent assault in early January in Ferguson Township.
According to the affidavit, officers met with a woman on Jan. 3 regarding an earlier incident. The woman reportedly advised them that she had spent the previous afternoon with two men, one of whom was identified as Colby J. Wagner, 20, of Warriors Mark.
In the early evening, police said, the three returned to her South Corl Street apartment and she began packing for an overnight stay at a friends house. She claimed that Wagner had come into her bedroom and began touching her “inappropriately,” attempting to take her clothes off and had exposed himself to her.
She stated that he had tried to get her to lay in bed with him as well, police said, and was able to get away from him by moving throughout the apartment. Wagner reportedly followed her, then both men left when she said that a friend was coming over.
The woman provided officers with texts between herself and Wagner on Jan. 11, police said. Messages from Wagner reportedly stated that he admitted to what he had done, referring to touching her where she didn’t want to be touched and trying to have sex with her.
Officers attempted a warranted search of Wagner’s phone on Jan. 12, police said, but Wagner had allegedly deleted the texts and the woman’s phone number.
In an interview with officers, Wagner reportedly stated he had been at the woman’s apartment with the other man, police said. He allegedly claimed he regretted that night, saying he had touched the woman though she had said “no” and also admitted to exposing himself to the woman.
Wagner was arraigned Monday before District Judge Casey McClain, according to court documents, and charged with misdemeanor counts of indecent assault without the consent and indecent exposure. Straight monetary bail was set at $30,000 and he was taken to the Centre County Correctional Facility.
A preliminary hearing is scheduled for Jan. 31.
