Bellefonte man pleads guilty to DUI in 2018 crash that killed passenger
A Bellefonte man pleaded guilty Monday to driving with a blood alcohol content nearly twice the legal limit for DUI and killing his passenger in a Rush Township car crash.
Anthony Diguardi Jr., 38, is set to serve three to six years in state prison after he pleaded guilty Monday to one felony count of homicide by vehicle while DUI, one misdemeanor count of DUI and one summary count of reckless driving.
Diguardi was driving at about 11:30 p.m. on Sept. 1, 2018 along Casanova Road when he failed to negotiate a curve, struck a street sign and hit a tree head-on, state police at Rockview wrote in an affidavit of probable cause.
Renny Baney, 41, died of blunt force trauma, Centre County Coroner Scott Sayers told police.
A Moshannon Valley EMS paramedic who spoke with Diguardi after the crash told police Diguardi said he was “drinking beer all day,” police wrote.
Diguardi’s blood alcohol content was 0.141%. Pennsylvania’s legal threshold for DUI is 0.08%.
He is scheduled to be sentenced Aug. 10, Centre County District Attorney Bernie Cantorna said.
