Centre County man charged with DUI after another man was seriously injured in Milesburg crash

A Centre County man was accused Tuesday of driving under the influence of marijuana when another man was hit and seriously injured in Milesburg.

Kolton R. Cain, 19, of Union Township, was accused of hitting the man with a BMW about 7:25 p.m. on Halloween in the 400 block of High Street. No defense lawyer was listed.

A Milesburg resident told state police at Rockview that Cain was driving at a high rate of speed and was “very loud,” a trooper wrote in an affidavit of probable cause. The other driver then got out of his vehicle, approached Cain and asked him to stop “driving crazy,” the resident told troopers.

Instead, Cain was accused of hitting the man and leaving the area. Police said the man was seriously injured in the crash, but did not offer additional details about his condition in the charging document.

There appeared to be conflicting accounts from witnesses.

In an interview with troopers, Cain said he tried to go around the man but was unable because he “jumped” onto the car. His passenger similarly told police it looked the man jumped onto the car but then said “either way Cain hit him,” police wrote.

A separate witness told police it appeared the man jumped and then rolled over Cain’s vehicle.

Cain had bloodshot eyes and appeared slow to react during an interview with a trooper, police wrote. He said he smoked marijuana about three hours before the crash and tested positive for the compound that gives pot its high, police wrote.

A drug recognition expert determined Cain was under the influence, police wrote.

Cain was charged with felony counts of aggravated assault by vehicle while DUI and accidents involving death or personal injury. He was also charged with misdemeanor counts of DUI and three summary traffic violations.

He was released after District Judge Kelley Gillette-Walker set bail at $100,000 unsecured. His preliminary hearing is scheduled for March 5.
