A breakdown of charges in Beta Theta Pi case

District Judge Allen Sinclair delivered his ruling in the Beta Theta Pi preliminary hearing on Friday.

Eighteen Beta Theta Pi members and the fraternity itself were charged in the death of Timothy Piazza, 19, who was fatally injured at a pledge event in February.

Sinclair made the following rulings:

▪ Alpha Upsilon chapter of Beta Theta Pi was bound over on 50 counts of hazing and 48 counts of furnishing alcohol to minors. The involuntary manslaughter charge was dismissed.

▪ President Brendan Young was bound over on one count of tampering with evidence, 14 counts of reckless endangerment, 12 counts of hazing, 12 counts of furnishing alcohol to minors and 12 counts of unlawful acts relative to liquor. Charges of involuntary manslaughter, aggravated assault, simple assault and remaining charges were dismissed.

▪ Daniel Casey was bound over on one count of tampering with evidence, 14 counts of reckless endangerment, 14 counts of hazing, 12 counts of furnishing alcohol to minors, 12 counts of unlawful acts relative to liquor and one count of consumption of alcohol by a minor. Charges of involuntary manslaughter, aggravated assault, simple assault and remaining charges were dismissed.

▪ Jonah Neuman was bound over on three counts of reckless endangerment, 14 counts of hazing, three counts of furnishing alcohol to minors, three counts of unlawful acts relative to liquor and one count of disorderly conduct. Charges of involuntary manslaughter, aggravated assault, simple assault and remaining charges were dismissed.

▪ Nick Kubera was bound over on six counts of reckless endangerment, one count of hazing, five counts of furnishing alcohol to minors, five counts of unlawful acts relative to liquor and one count of consumption of alcohol by a minor. Charges of involuntary manslaughter, aggravated assault, simple assault and remaining charges were dismissed.

▪ Michael Bonatucci was bound over on five counts of reckless endangerment, one count of hazing, four counts of furnishing alcohol to minors, four counts of unlawful acts relative to liquor and one count of consumption of alcohol by a minor. Charges of involuntary manslaughter, aggravated assault, simple assault and remaining charges were dismissed.

▪ Gary Dibileo was bound over on 14 counts of reckless endangerment, 14 counts of hazing, 12 counts of furnishing alcohol to minors, 12 counts of unlawful acts relative to liquor and one count of consumption of alcohol by a minor. Charges of involuntary manslaughter, aggravated assault and simple assault were dismissed.

▪ Luke Visser was bound over on 14 counts of reckless endangerment, 14 counts of hazing, 12 counts of furnishing alcohol to minors and 12 counts of unlawful acts relative to liquor. Charges of involuntary manslaughter, aggravated assault, simple assault and consumption of alcohol by a minor were dismissed.

▪ Joseph Sala was bound over on 14 counts of hazing, two counts of furnishing alcohol to minors and two counts of unlawful acts relative to liquor. Charges of involuntary manslaughter, aggravated assault, simple assault, reckless endangerment and remaining charges were dismissed.

▪ Michael Angelo Schiavone was bound over on one count of reckless endangerment and 14 counts of hazing. The remaining reckless endangerment charges and charges of furnishing alcohol to minors and unlawful acts relative to liquor were dismissed.

▪ Craig Heimer was bound over on 12 counts of furnishing alcohol to minors and 12 counts of unlawful acts relative to liquor. Charges of reckless endangerment and hazing were dismissed.

▪ Lars Kenyon was bound over on 14 counts of hazing. Charges of reckless endangerment, furnishing alcohol to minors and unlawful acts relative to liquor were dismissed.

▪ Parker Yochim was bound over on 14 counts of hazing, 12 counts of furnishing alcohol to minors and 12 counts of unlawful acts relative to liquor. Charges of reckless endangerment were dismissed.

▪ Joseph Ems had one charge of reckless endangerment dismissed.

▪ Ryan McCann had one charge of tampering with evidence dismissed.

▪ Lucas Rockwell had one charge of tampering with evidence dismissed.

▪ Braxton Becker had one charge of tampering with evidence dismissed.

▪ Brothers Ed Gilmartin and Ryan Foster waived their right to a preliminary hearing prior to the beginning of the proceedings. Gilmartin and Foster were each charged with one count of tampering with evidence.
