He’s going to trial for possessing a gun. But was it his?
A Philadelphia man was bound over for trial Wednesday after allegedly possessing a gun that he was not allowed to carry, according to Patton Township police.
His attorney says he wasn’t, though.
Police responded to a disorderly conduct on Jan. 29, when one male pointed a handgun toward an individualand took cash from his wallet, according to police. The suspect was identified as 23-year-old Achilles Watson.
The name and date of birth that Watson provided could not be corroborated by police initially. His identity was confirmed after he was fingerprinted at the Centre County Correctional Facility.
The firearm was found in the vehicle stopped by officers on North Atherton Street. The weapon was found in a backpack in the trunk of the car where Watson was a passenger. Police said the weapon was located in an area accessible by Watson.
Detective Erik Haas said the gun was operational and had a fully loaded magazine. Haas said he was not aware of who owned the backpack and said the gun was not fingerprinted, which became part of Brian Manchester’s argument.
Manchester, Watson’s attorney, said the gun was in a car that was not owned by Watson, the gun was not fingerprinted and there was no ID in the backpack that would have connected Watson to it.
A records check on Watson revealed there was no record found for a permit/license to carry. A criminal history check revealed Watson had a previous conviction for a violation of carrying a firearm without license in 2015.
He also had a 2015 conviction, which precluded him from being able to possess, use or control firearms.
Watson is charged with one felony count of prohibited possession of a firearm, one felony count of firearms not to be carried without a license and one misdemeanor count of false identification to a law enforcement officer.
