Centre County man with long history of exposing himself in public gets more jail time
A Centre County man with a long history of exposing his genitals in public was sentenced Monday for his latest conviction and avoided a return to state prison, though he was ordered to spend at least several more months in jail.
Kelvin J. Flory, 62, of Port Matilda, was sentenced by Centre County Judge Katie Oliver to eight to 23 1/2 months in the Centre County Correctional Facility. He received credit for the about 5 1/2 months he’s served in the jail since his August arrest.
Oliver said she considered sentencing Flory to the maximum allowed by law — one to two years in state prison — but “talked myself out of it.” The circumstances of his latest crime did not warrant such a sentence, she found.
“I don’t want to sentence out of anger and I’ve stepped away from that and that’s why I’m not imposing the maximum sentence as I sit here,” Oliver said.
Flory was charged for standing almost completely nude in the backyard of a home along the 500 block of West Front Street in Port Matilda. He also peered into the homeowner’s window and was in “full view” of anyone inside the home or the surrounding area, Centre County Assistant District Attorney Hunter Fedora wrote in a memo sent to Oliver.
Flory was caught on camera and admitted it was him on the footage, state police at Rockview wrote in an affidavit of probable cause. He pleaded guilty in November to a misdemeanor count of indecent exposure. Three other lesser charges were dropped.
He apologized Monday, telling Oliver he didn’t want to “cause a scare.”
“I’d like to apologize and say I’m sorry for the way that anybody saw me,” Flory said.
The conviction was the latest in a long line of them for similar behavior dating back to 1994. Flory’s record includes more than a dozen misdemeanor convictions for indecent exposure and open lewdness.
In his most recent arrest, Flory was caught walking nude just eight days after being released from a state prison where he served the entirety of a lengthy sentence.
He was sentenced in April 2013 to serve six to 12 years in state prison for masturbating and publicly running around naked in the State College and Bellefonte areas.
His spate of arrests included running naked between homes and Community Field along South Atherton Street, masturbating near the Bellefonte YMCA and exposing himself to employees of local businesses.
“I wish I had some magic answer to what might help Mr. Flory to not engage in this kind of conduct again,” Oliver said Monday as she announced his sentence. “Looking at a new offense for similar conduct just eight days after having been released from a lengthy prison sentence, I don’t know what that would be.”
